Maryland Buyers Remorse Laws

Like many other states, there are few Maryland buyers remorse laws that permit consumers to cancel contracts within 3 days. Normally, once a buyer signs a contract for real estate, a new or used car or another major purchase, they are obligated to abide by the terms of the contract.
Maryland law does make an exception for health club contracts. According to the Maryland attorney General’s Consumer Education series, fitness today is no longer a fad; it’s big business. More than 400 health spas, weight loss centers and self-defense schools in Maryland cater to thousands of consumers who want to get ‹and stay) in shape.
Unfortunately, some of these health and fitness clubs are not in the best shape themselves. Given the intense competition for customers, some would-be marketers of muscle and tone use questionable methods to break into the business. Their finances may be shaky. They may seek a quick infusion of cash by offering razzle-dazzle promotions that may fail to comply with Maryland’s Health Club Services Act or consumer protection laws. Both of these laws help prevent consumers from being sold something they do not want or being left stranded without a refund if the club they join shuts down‹or does not open at all.
After you sign a contract for health club services, you have three business days in which to cancel it and still receive a full refund of any deposit or down payment you have made. To cancel the agreement, you must notify the club in writing and either send the notice by certified or registered mail, or deliver it in person. If it is mailed, it must be postmarked by midnight of the third business day following the day you signed the agreement in order for the cancellation to be valid.
If a bonded health club closes its doors suddenly or fails to open up at all, you can seek a refund by filing a claim against the bond the club obtained. The claim must be filed with the specific bonding company used by the club. The Consumer Protection Division will help you find out where you can go to get your money back.
