West Virginia Sex Offender Laws

The West Virginia sex offender laws have two main parts. These parts are set to help victims during the criminal proceedings and to help the general public protect themselves from convicted sex offenders when they are released from prison.
The first part of the West Virginia sex offender laws are meant to help victims of sex offenses and is referred to as the victim’s bill of rights. This bill of rights grants victims the right to be treated with respect, the right to be reasonably protected from the accused, the right to be notified of court proceedings, the right to be present at public court proceedings and the right to be informed about the conviction, sentencing and release of the accused offender.
The second part of the West Virginia sex offender laws refers to what happens when convicted sex offenders are released from prison. Federal law requires each state to have a sex offender registry, but each state is able to define how they want to handle their sex offender registry. In West Virginia, the sex offender registry is retroactive, so anyone who has been convicted of committing or attempting to commit a qualifying offense must register with the state within three days of release from prison, within 10 days of moving into the state and within 10 days of changing address. Registration requires the sex offender to provide the state with his or her name, social security number, date of birth, physical description, address, employment information, description of crime and conviction, fingerprints and a photograph.
According to the West Virginia sex offender laws, some of the information on the registry is accessible by the public. People can access the information about the sex offenders who are required to be on the list for life through the state’s website.
