Vermont Sex Offender Laws

The Vermont sex offender laws have two main parts that are meant to help victims throughout the criminal proceedings as well as to help the general public stay informed about and protect themselves from convicted sex offenders living in their neighborhoods and communities.
The first part of the sex offender laws refers to what happens to victims during the criminal proceedings. This is also referred to as a victim’s bill of rights and gives victims certain rights. These include the right to be referred to places that can help them including counseling, the right get protection from the police and the right to be in court for the defendant’s arraignment. It also includes the right to be treated with respect by the court system, the right to be informed about the criminal proceedings, the right to be informed about possible plea agreements and the right to attend and speak at the defendant’s sentencing hearing.
The second part of the Vermont sex offender laws refers to how the state informs the public about convicted sex offenders who have been released from prison. This stems from the federal law that requires all states to have a sex offender registry. In Vermont, those convicted of sexual assault, aggravated sexual assault, lewd and lascivious conduct and sexual activity by a caregiver need to register with the state within ten days of moving into the state and within ten days of release from prison. Register with the state requires the convicted sex offender to provide the state with his or her name, date of birth, physical description, phone number, fingerprints, a photograph, employment information and a description of the offense. Failure to comply with the requirements of the sex offender registry can result in a fine of up to $1000 and a prison sentence of up to two years. Subsequent offenses result in fines of up to $5000 and a prison sentence of up to three years. The information on the Vermont sex offender registry can be found on the state’s website.
