Utah Sex Offender Laws
Posted by Becca
The Utah sex offender laws have two main parts. The first part is meant to protect victims during the criminal proceedings and the second part stems from the federal laws that require states to help protect the general public from convicted sex offenders who have been released from prison.
According to one section of the Utah sex offender laws, the state grants victims certain rights during the criminal proceedings of those accused in the case. These rights include the right to be treated with respect, the right to be present at important hearings and the right to be heard during pertinent criminal proceedings such as sentencing and parole hearings.
The second part of the Utah sex offender laws refers to the federal requirement that all states have a sex offender registry. The federal law does allow each state to define their specific parameters of the their individual registries and in Utah, adult sex offenders are required to register with the state immediately upon release from prison and within ten days of changing address. When registering with the state, convicted sex offenders are required to provide the state with their names, photographs, date of birth, physical description, vehicle description, offense description and other identifying information. Failure to comply with the requirements of the Utah sex offender registry results in a third degree felony for those who are required to be on the registry for life and a class A misdemeanor or for misdemeanant registrants.
According to the Utah sex offender laws, the information on the sex offender registry must be made accessible to the public. Anyone can get the information via the internet or by contacting the state’s Sex Offender Registration Program to get the requested information sent via US Mail.
