South Dakota Sex Offender Laws

The South Dakota sex offender laws have two main parts, just like the rest of the states. These parts help victims retain their rights throughout the criminal proceedings of those accused in the case and they also help keep the general public informed about convicted sex offenders living in their communities.
The first part of the South Dakota sex offender laws is actually a victim’s bill of rights. It grants certain rights to victims of sex crimes and they include the right the be treated with respect, the right to be reasonably protected from the accused, the right to be notified of court proceedings, the right to be present at public court proceedings and the right to be informed about the conviction, sentencing, imprisonment and release of the offender.
The second part of the South Dakota sex offender laws stem from the federal law that requires all states to have a sex offender registry. While it is a requirement for all states to have the registry, the states can define the parameters of their individual registries. In South Dakota, anyone who has been convicted of a sex crime must register as a sex offender within five days of being released from prison, of entering the state or of changing address. Registering with the state requires convicted sex offenders to provide the state with his or her name and aliases, a complete description, a photograph, fingerprints, residence information and a description of the sex crime. Failing to comply with the requirements of the sex offender registry results in a class 6 felony.
According to the South Dakota sex offender laws, the information on the registry is available to the public. This information is available to local law enforcement agencies and also accessible online.
